These visas can be granted on the basis of the following relationships:
Partner and Family relationships (including those who are engaged to be married);
- Relationships between people who are legally married;
- De facto relationships between people of the same sex;
- De facto relationships between people of the opposite sex.
- Prospective Marriage – also known as a ‘fiancé’ visa, this visa is for a person who is engaged, but not yet married, to an Australian citizen, an Australian permanent resident or an ENZ citizen. It can lead to a temporary resident and in turn a permanent resident visa
- Partner (Provisional) – is a temporary visa for a person who is married to, or in a de facto relationship with, an Australian citizen, an Australian permanent resident or an ENZ citizen, and who is outside Australia when they apply. The visa is ‘provisional’ in that it is temporary and can lead to the grant of a permanent partner visa.
- Partner – this is a permanent visa for a person who is married to, or in a de facto relationship with, an Australian citizen, an Australian permanent resident or an ENZ citizen;
- Partner (Temp) – is a temporary visa for a person who is married to, or in a de facto relationship with, an Australian citizen, an Australian permanent resident or an ENZ citizen. This visa is for applicants who are in Australia when they apply. The visa is ‘provisional’ in that it can lead to the grant of a permanent Partner visa;
- Partner (Permanent) – this is another permanent visa for a person who is married to, or in a de facto relationship with, an Australian citizen, an Australian permanent resident or an ENZ citizen
- Dependent Child – this is a temporary visa for a child or step child of a parent who holds a temporary partner visa and who has not yet been granted a permanent partner visa.
It is also possible under certain circumstances for visas to be granted to former partners of Australian citizens, Australian permanent residents and ENZ citizens subject to strict required criteria being met.
Family visas are for those who are related (including de facto) to an Australian citizen, permanent resident or an Eligible New Zealand (ENZ) citizen.
The nature of the relationship required depends on the subclass of visa applied for and includes biological relationships, adoptive relationships, step relationships and relationships created by legislation or court orders. After considering the information below contact us to make an appointment.
In addition to the existence of the relationship a large number of other requirements must also be satisfied in order for a visa to be granted.
The visas covered are:
Parents
- Parent – for the parent(s) of an Australian citizen, a permanent resident or an ENZ citizen
- Aged Parent – for the aged parent(s) of an Australian citizen, a permanent resident or an ENZ citizen).
- Contributory Aged Parent – for the aged parent(s) of an Australian citizen, a permanent resident or an ENZ citizen
- Contributory Parent – for the parent(s) of an Australian citizen, a permanent resident or an ENZ citizen.
Children
- Child – for children of an Australian citizen, the ‘holder of a permanent visa’ an ENZ citizen. Special provisions apply in respect of ‘vulnerable children’
- Dependent child -a temporary visa for the dependent children of provisional partner visa holders:
- Adoption – for the adopted child of an Australian citizen, the ‘holder of a permanent visa’ or an ENZ citizen.
- Orphan Relative – for orphaned relatives of an Australian citizen, a permanent resident or an ENZ citizen.
Other relatives
- Aged Dependent Relative – for single, widowed, divorced or formally separated relatives who are dependent on an Australian citizen, a permanent resident or an ENZ citizen relative.
- Carer – for the relative of an Australian citizen, a permanent resident or an ENZ citizen who has a medical condition, or whose family member has a medical condition, requiring care.
- Remaining Relative – for the last remaining relative of an Australian citizen, a permanent resident or an ENZ citizen.
Family members of New Zealand citizens who are not ENZ citizens cannot apply for these visas but may be eligible for a special subclass.
