Have you received a ‘Notice of Intention to Consider Cancellation’ (NOICC) from the Immigration Department? Under the Migration Act 1958, there are several situations in which the Minister may cancel the visa of a current visa holder. For example failure to comply with visa conditions can result in the cancellation of your visa, either with notice or automatically, depending on the type of visa held and the reasons for cancellation.
All non-citizens can potentially have a visa cancelled, whether the visa held is permanent, temporary, substantive or not. Cancellation can occur regardless of the length of time a person has been resident in Australia. When a visa is cancelled, it ceases to be in effect. There are serious consequences to having a visa cancelled; you are subject to being removed from Australia including other secondary visa holders, the inability to apply for any other visa and a re-entry ban.
Circumstances where your visa may be cancelled include:
- provision of incorrect information
- provision of bogus documents
- visa conditions being breached or other requirements not being met (the ‘general’ cancellation power)
- failure of a business skills visa holder to establish the business or participate in management
- a student visa holder does not meet the course attendance and/or academic performance visa condition
- the holder of a Regional Sponsored Migration Scheme (RSMS) visa either did not commence work within six months, or did not complete two years of employment with their employer.
- Section 501 of the Migration Act: Refusal or cancellation of visa on character grounds. A person may not pass the character test for a variety of reasons, including; having a substantial criminal record or being convicted of an offence committed whilst in immigration detention.
